Facts

The Plaintiff/Appellant was an employee of the Defendant/Respondent effective from August 4th 1983.

In September 1987, a petition was sent by two individuals of the National Union of Banks, Insurance and Financial Institution against the Plaintiff. As a direct result of the petition, the Defendant suspended the Plaintiff from work.

The petition was later withdrawn but the Plaintiff was not recalled from the suspension. He was instead was summarily dismissed from the Defendant's employment. The Plaintiff then instituted an action challenging his dismissal.

The trial Court granted a substantial part of the Plaintiff's claim. The Defendant's appeal against the decision of the trial Court was allowed. The Plaintiff consequently appealed to the Supreme Court.
